Terms and Conditions.
1. Purpose and Scope
These Terms and Conditions define the scope, responsibilities, and limitations of the Material Compliance Services provided by EAO. All assessments are based exclusively on information received from suppliers and available at the time of review. EAO provides documentation and declarations to support the customer’s internal compliance processes but does not guarantee full, continuous, or global regulatory conformity of customer products.
In case of discrepancies between Marketing Material and these Terms and Conditions, the Terms and Conditions prevail.
2. Service Levels
EAO offers two defined service levels for Material Compliance.
2.1 Standard Service (Free of Charge)
The Standard Service includes:
- Essential compliance documentation in commonly used formats (e.g., IPC‑1752, IEC 62474, chemSHERPA)
- Coverage of major regulatory requirements (e.g., REACH, RoHS, SCIP)
- Documentation based solely on information available at the time of assessment.
2.2 Advanced Service (Fee-Based)
The Advanced Service applies to customer‑specific products or extended documentation requirements. It includes:
- Preparation of customised formats
- Reporting or customer‑specified templates
- Uploads to external platforms (e.g., BOMcheck, iPoint, Assent)
All Advanced Service work is subject to the applicable pricing model.
3. Customer Responsibility
The customer is responsible for:
- Providing complete, accurate, and timely compliance requirements, product data, and documentation
- Communicating compliance requirements for customised parts during the development phase so they can be considered in design, certification, and sampling
- Assessing regulatory applicability to their own products and verifying that the documentation provided meets internal and external expectations.
Late or changed requirements may result in additional effort and additional costs.
4. Responsibility and Transparency
All material compliance declarations, reports, and certificates provided by EAO constitute a contractual service limited to an assessment based on information made available by third-party suppliers and subcontractors. Such declarations reflect the compliance status to the best of EAO’s knowledge at the time of issuance and do not constitute a guarantee, assurance, or warranty of actual or continued regulatory compliance. Unless expressly agreed in writing, EAO does not perform independent testing, laboratory analysis, or on-site audits of supplier materials. Due to evolving regulatory frameworks, scientific developments, and complex global supply chains, no representation is made as to the completeness, accuracy, or future validity of the information provided. Compliance declarations are intended to support the customer’s internal compliance processes and regulatory documentation and do not release the customer from its own duty to verify product compliance and regulatory suitability. Customer-specific reporting formats, data uploads to external platforms (e.g. SCIP, IMDS), product carbon footprint calculations, and comparable services are rendered as services of effort (Best-Effort-Services) and without result liability. With regard to PFAS and other emerging substance regulations, EAO performs its assessment with due professional care; however: due to incomplete regulatory definitions, evolving substance scopes, and limited availability of reliable supply chain data, a comprehensive and gapless assessment cannot be ensured. Liability for incorrect, incomplete, or subsequently changing material compliance information is excluded to the extent permitted by applicable law, except in cases of intent or gross negligence.
5. Advanced Service Pricing
- Basic fee
- Volume‑based price per article
- Individual pricing for larger volumes or complex customer requirements
Final pricing is confirmed in the official quotation.
6. Use of Data and External Platforms
Uploads to customer‑requested platforms (e.g. CDX, IMDS, iPoint, Assent) are performed on a best‑effort basis. EAO is not responsible for:
- Platform availability or performance
- System errors or validation rules
- Customer account configuration or workflow definitions
7. Validity of Documentation
Compliance documentation reflects the status at the time of issuance. EAO does not automatically update documentation unless contractually agreed. Customers remain responsible for ensuring regulatory updates are reflected in their own systems and product assessments.
8. Final Provisions
EAO reserves the right to adjust service scope, pricing, or conditions at any time. Updates apply to future orders unless legally required otherwise.
These Terms and Conditions are governed by Swiss law. Place of jurisdiction is Olten, Switzerland, unless otherwise agreed in writing.
